1)Â A dedicated MGA licence is now required: MGAs are now treated as a distinct regulated category in the IFSC and can no longer rely on the earlier insurance intermediary regime.
2)Â Foreign insurer backing is key: Registration requires a Binding Authority Agreement with an eligible foreign insurer, which must meet prescribed net worth and rating thresholds.
3)Â Capital and safeguards are built-in: MGAs must maintain minimum capital and net worth, hold professional indemnity cover, and place regulatory deposits, with capital funded from owned funds.
4) Client funds must be ring-fenced: Premiums and claims monies must be kept separate from the MGA’s own funds, used only for permitted purposes, and remitted periodically.
5)Â Business scope is clearly defined: MGAs may operate within the IFSC and/or offshore, but cannot solicit domestic Indian business or undertake prohibited activities such as reinsurance binding, syndicate participation or further delegation.
6)Â Ongoing oversight will be active: MGAs will be subject to audited financials, periodic reporting, related party disclosures and IFSCA supervision.
