Algorithmic Accountability India’s Bold Move to Regulate AI

Brief Overview:

The Artificial Intelligence (Ethics and Accountability) Bill, 2025, recently tabled in the Lok Sabha, aims to usher in a new era of responsible AI in India and lays down a clear framework to ensure ethical practices, transparency, and accountability in the deployment of cutting-edge AI.

Technical Details:

1) Ethics Committee: Setting up a multidisciplinary committee (“Committee”) to develop and recommend guidelines for AI technologies, monitor compliance with ethical standards in AI systems, and review cases of misuse, bias or violations of the Act.

2) AI use in critical decisions in law enforcement, financial credit and employment must not discriminate basis race, religion or gender.

(a) Use of AI in surveillance only with prior approval of the Committee.

(b) AI Developers must:

(i) disclose purpose and limitations of AI, data sources and methodologies, reasons for AI made decisions impacting individuals;

(ii) prevent systematic errors that result in unfair outcomes through regular audits, ensuring diversity, and withdraw AI with significant bias until corrected; and

(iii) maintain compliance records.

(c) Aggrieved persons may file complaint with the Committee.

(d) Penalties: Up to ₹5 crore; repeat violations may attract criminal liability.
